De repente han surgido por las calles de Madrid cientos de patinetes eléctricos marca y modelo Patinete eléctrico Lime S, de color blanco, negro y verde lima (de ahí el nombre que toman de Lime, de ese cítrico), aparcados en la acera, a veces de mala manera, o pisándonos los talones por la acera en la carrera alocada de su conductor.

Patinete electrico Lime S (logo)

Se trata de una iniciativa de una compañía norteamericana fundada por Toby Sun y participada por Uber y Alphabet (Google) que ofrece un servicio de alquiler de patinetes eléctricos compartidos sin aparcamiento fijo. Y desde hace unas semanas ya opera en Valencia y Madrid (interior de la M30).

Todo por el coste de un euro por desbloquear el patinete de tu elección con el móvil y 15 céntimos de euro por cada minuto que el patinete esté desbloqueado en nuestra posesión.

Ya hemos leído varias noticias en prensa sobre la posibilidad de que en Madrid solo puedan ser usados de forma muy restringida (fuera de las aceras por descontado) y en Valencia, el ayuntamiento ha prohibido estos patinetes en septiembre aunque la compañía los ha vuelto a poner en marcha.

Pero con independencia de estas regulaciones o limitaciones de uso, en Consumoteca nos preocupa bastante más la forma de contratar este servicio y las responsabilidades en las que incurres cuando escaneas el código QR individual de un patinete para convertirte en un Lime Rider.

User agreement de Lime

Lo primero que llama la atención es que la web está traducida al español pero muchas imágenes con texto y algunos botones de acción siguen en inglés.

Por su parte, las normas de utilización del servicio de alquiler de patinetes eléctricos de Lime (user agreement) solo se ofrecen en inglés (la página con las condiciones de uso en español muestra un «Error 404»). Y además, son las originales vigentes en Estados Unidos, donde el Derecho y la protección del consumidor no tienen absolutamente nada que ver con lo que aquí en España se estila.

En cuanto a su localización, estas condiciones de uso están en el pie de página en la versión de escritorio de LimeBike, pero francamente escondidas en la versión para móvil, pasando desapercibidas si contratas desde tu móvil, con lo cual, es difícil que las leas alguna vez, antes de usar los patinetes.

Ya que tú es posible que no las leas, vamos a hacer el esfuerzo nosotros de hacerlo por ti (aunque sea en inglés y estén pensadas para un usuario norteamericano), y aquí te destacamos lo más relevante de su versión de junio 2018 (June 11, 2018) para que te ahorres algún que otro problemilla.

Cosas que tienes que saber como usuario

Si usas lime, aceptas sus condiciones y renuncias a cosas…

Y la primera de ellas es que usando un patinete de Lime, renuncias a acciones legales en Tribunales (específicamente se refiere a las «acciones de clase» norteamericanas por las que bastaría una condena por parte de un demandante para que cualquier otro perjudicado por cualquier razón, tuviera derecho a la misma compensación sin tener que litigar individualmente).

Y además de esta renuncia, te obligas a aceptar que cualquier problema se resolverá mediante arbitraje de un organismo llamado JAMS (ojo, arbitraje en sentido amplio y no necesariamente arbitraje de consumo como lo entendemos en España).

This User Agreement & Terms of Service (collectively, the “Agreement”) is a legally binding agreement between you (“You,” “Your,” or “User”) and Neutron Holdings, Inc., doing business as LimeBike, and doing business as Lime (“Lime,” “We,” “Us,” or “Our”). This Agreement states the material terms and conditions that governs Your use of Our Services.

Edad mínima de los Lime Riders

Lime básicamente lo que hace es «alquilarte» un producto de su propiedad para permitirte su uso, a cambio de un precio, y con una serie de condiciones y limitaciones.

Una de estas es que el que alquila debe ser el único usuario del patinete y no lo puede/debe prestar a nadie más:

1. RENTAL AND USE OF PRODUCTS.

1.1. You are the Sole User of the Services : Subject to Section 1.3 below regarding the limited use of Bikes by minors, You certify and expressly agree that You are the sole renter and You are responsible for compliance with all terms and conditions contained in this Agreement. You understand that when You activate a Product, the Product must be used ONLY BY YOU. You must not allow others to use a Product that You have activated.

La segunda es que debes tener más de 18 años para ser usuario y debes tener permiso de conducir válido.

Excepcionalmente, un mayor de 16 puede usarlo siendo el padre o tutor el responsable y aceptando su responsabilidad financiera por los daños y perjuicios que se puedan causar.

1.2. You are At Least 18 Years Old : You represent and certify that You are at least 18 years old, and that You have a valid driver’s license.

1.3. Minor Use of Bikes : You may allow a minor who is at least 16 years of age to use a BIKE ONLY, subject to the following conditions:

1.3.1. You are the minor’s parent or legal guardian;

1.3.2. You assume full financial and/or any other responsibility for any and all misuse, consequences, claims, demands, causes of action, losses, liabilities, damages, injuries, fees, costs and expenses, penalties, attorneys’ fees, judgments, suits and/or disbursements of any kind, or nature whatsoever, whether foreseeable or unforeseeable, and whether known or unknown, as a result of the minor’s use of the Bike and/or any of the Services;

1.3.3. You expressly guarantee, represent, and warrant that You and the minor are bound by this Agreement and all of the terms herein;

1.3.4. You expressly guarantee, represent, and warrant that You will supervise the minor at all times while the minor is using the Bike;

1.3.5. You expressly guarantee, represent, and warrant that You have conducted the requisite safety check of the Bike prior to use, and that You will constantly monitor the Bike while the minor is riding to ensure safety;

1.3.6. You expressly guarantee, represent, and warrant that the minor is wearing a Snell, CPSC, ANSI or ASTM approved helmet that has been properly sized, fitted and fastened according to the manufacturer’s instructions at all times while riding the Bike; and

1.3.7. You expressly guarantee, represent, and warrant that You have explained all applicable laws, rules, regulations, and/or ordinances to the minor, including any and all rules regarding parking and traffic laws.

OPERATION OR USE OF ANY E-VEHICLES BY ANY MINOR IS EXPRESSLY PROHIBITED. IF YOU ALLOW A MINOR TO USE AN E-VEHICLE BY ACTIVATING IT THROUGH YOUR ACCOUNT, YOU SHALL BE RESPONSIBLE FOR ANY AND ALL MISUSE, CONSEQUENCES, CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, LIABILITIES, DAMAGES, INJURIES, FEES, COSTS AND EXPENSES, PENALTIES, ATTORNEYS’ FEES, JUDGMENTS, SUITS AND/OR DISBURSEMENTS OF ANY KIND, OR NATURE WHATSOEVER, WHETHER FORESEEABLE OR UNFORESEEABLE, AND WHETHER KNOWN OR UNKNOWN.

Coste mínimo y máximo

El coste de desbloquear un patinete es de 1 euro y a partir de ese momento, pagarás 15 céntimos por minuto de uso hasta su bloqueo de nuevo mediante el móvil.

Sólo podrás alquilar el mismo patinete un máximo de 24 horas y te haces responsable frente a ellos de bloquear el patinete al finalizar su uso. Si no lo haces, ya sabes, te tocará seguir pagando.

3.3. Maximum Rental Time and Charges : Maximum rental time is 24 hours. You agree that You will deactivate the Product rental within 24 hours of time that rental of the Product began. You may then rent again. You agree that You are solely responsible for being aware of any elapsed time related to timely locking any Product.

Además debes dar de alta una tarjeta bancaria con fondos y autorizas para que se use para cobrarte cualquier tipo de cargo:

3.4.Valid Credit Card or Debit Card : You must input a valid Card number and expiration date before You will be registered to use the Services. You represent and warrant to Lime that You are authorized to use any Cards You furnish to Lime. You authorize Lime to charge the Card for all fees incurred by You.

Idoneidad para conducir patinetes

Cuando decides usar un patinete Lime S, declaras tener las habilidades y aptitudes físicas y motrices para manejar este propulsor y además, según Lime, asumes la responsabilidad a te cualquier daño.

También asumes tener la prudencia de no utilizar los patinetes eléctricos (o de hacerlo bajo tu entera responsabilidad) en condiciones de lluvia o nieve.

1.4. You are a Competent Operator : You represent and certify that You are familiar with the operation of the Product, and You are reasonably competent and physically fit to use the Product. By choosing to ride a Product, You assume all responsibilities and risks for any injuries and/or medical conditions, as detailed further below. You are responsible for determining whether conditions, including rain, snow, hail, ice or electrical storms, and/or any other conditions, whether caused by the weather or otherwise, make it dangerous to operate a Product. You are advised to adjust Your riding behavior and braking distance to suit all conditions and variables, including weather and traffic.

Conducir solo donde esté permitido

Como Lime Rider aceptas y te comprometes a conducir el patinete sólo donde esté permitido. En Madrid, la nueva Ordenanza Municipal de Movilidad de Madrid no permite usarlos en los carriles bici, así que hay usuarios de patinetes que ya están recibiendo multas de 90 euros. Aparte de la multa que te pueda «cascar» el ayuntamiento de turno Lime se reserva la potestad de cargarte una multa de 50 dólares en tu cuenta por el incumplimiento.

1.6. Only Use Products Where Allowed : You expressly agree that You will only use the Products in areas where the Products are allowed. You agree that You will not use any Products in any restricted areas (such as cities that prohibit certain Products), and You assume all responsibility and liability for any operation of any Product in any restricted area, including any fines or fees as a result of Your use of any of the Products in any restricted areas. Lime reserves the right to charge You up to $50, in Lime’s sole and absolute discretion, if You use any of the Products in any restricted areas.

Conducción inadecuada

También, como Rider, te comprometes a cumplir con prohibiciones de llevar bultos contigo que impidan la conducción, a usar el móvil mientras conduces, a conducir ebrio o drogado, o a llevar a una segunda persona en el patinete:

1.9. Prohibited Acts : YOU EXPRESSLY CERTIFY AND AGREE THAT YOU WILL NOT:

1.9.2. Operate any Product while carrying any briefcase, backpack, bag, or other item if it impedes Your ability to operate safely the Product.

1.9.3. Use any cellular telephone, text messaging Device, portable music player, and/or any other Device that may distract You from safely operating any Product.

1.9.4. Operate any Product while under the influence of any alcohol, drugs, medication, and/or any other substance that may impair Your ability to safely operate any Product.

1.9.5. Carry any other person on any of the Products.

1.9.6. Use locking mechanisms other than those provided by Lime.

Aparcamiento indebido

Si aparcas el patinete en un lugar indebido tanto porque Lime lo desaconseja (fuera de la zona operativa de sus patinetes), o porque el ayuntamiento de turno no lo permite, Lime te encasquetará a tu cuenta cualquier multa que les pueda llegar a ellos.

Además, si aparcaras de tal manera que la empresa tuviera que ir a «rescatar» el patinete se reservan el derecho a cargarte 450 dólares.

1.8. Payment of Fines and Fees : You agree to pay any fines, fees, penalties, impounding charges, and/or any other charges incurred by Lime, that result from You parking any Product improperly, or as a result of You violating any law, rule, regulation, and/or ordinance while using the Services.

1.9. Prohibited Acts : YOU EXPRESSLY CERTIFY AND AGREE THAT YOU WILL NOT:

1.9.8. Park or place any Product in a manner that prevents Lime from accessing it. If You violate this Section, Lime may charge You up to $450, in Our sole and absolute discretion.

Responsabilidades que asumes como usuario

Aquí es donde la cosa se pone interesante, ya que, como vas a leer a continuación, conducir uno de estos patinetes eléctricos puede salirte muy caro si tienes cualquier percance.

De entrada, mira todo lo que te hace asumir la compañía a través de su condicionado, cuando usas su patinete:

1.14. Assumption of Liability by You : YOU AGREE THAT YOU ARE SOLELY RESPONSIBLE AND LIABLE FOR ANY MISUSE, CONSEQUENCES, CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, LIABILITIES, DAMAGES, INJURIES, FEES, COSTS AND EXPENSES, PENALTIES, ATTORNEYS’ FEES, JUDGMENTS, SUITS AND/OR DISBURSEMENTS OF ANY KIND, OR NATURE WHATSOEVER, WHETHER FORESEEABLE OR UNFORESEEABLE, AND WHETHER KNOWN OR UNKNOWN, AS A RESULT OF USING ANY OF THE SERVICES.

7.4.3. You agree that riding the Products involves many obvious and not-so-obvious risks, dangers, and hazards, which may result in injury or death to You or others, as well as damage to property, and that such risks, dangers, and hazards cannot always be predicted or avoided.

7.4.4. You agree that such risks, dangers, and hazards are Your sole responsibility, including, but not limited to, choosing whether to wear a helmet other protective gear.

Lo primero que tienes que saber es que si se produce algún incidente con el patinete que provoque daños a terceros, a ti, o al patinete, tienes la obligación de contactar con Lime asap y pedir a la policía municipal el atestado del accidente donde quede constancia de lo sucedido:

1.13. Reporting of Damage or Crashes: You must report any accident, crash, damage, personal injury, stolen or lost Product to Lime as soon as possible. If a crash involves personal injury, property damage, or a stolen Product, You shall file a report with the local police department within 24 hours.

Y si le pasa cualquier cosa al patinete o no lo devuelves como estaba, asumes pagar el coste de su reparación, hasta 1.500 dólares por cada patinete:

1.15. You are Responsible for Product Damage; Vandalism : You agree to return any Product to Lime in the same condition in which such Product was rented. You agree that You will be responsible for the cost of repairing and/or replacing any Product that You damage and/or cause damage to. You will not be responsible for normal wear and tear of the Products. If You vandalize any Product, You shall be liable for up to $600 for each Bike, $2,000 for each Lime-E, and $1,500 for each Lime-S, in Lime’s sole and absolute discretion.

En definitiva

La palabra «seguro», «aseguradora», etc. no aparece por ninguna parte en las condiciones de uso de Lime S. Esto quiere decir que, otra brillante iniciativa de la economía colaborativa para el transporte dinámico de la gente, que evita atascos y reduce la contaminación, no resuelve el problema de la responsabilidad civil de los vehículos y sus conductores con vehículos capaces de moverse a 24 km/h.
